CONTEST RULES
1. Eligibility. NO PURCHASE NECESSARY TO ENTER OR WIN; PURCHASE
WILL NOT IMPROVE ODDS OF WINNING. CONTEST OFFERED AND OPEN ONLY
TO RESIDENTS OF THE UNITED STATES AND THE DISTRICT OF COLUMBIA,
EXCLUDING PUERTO RICO. To be eligible to win a prize, entries
must be completed and received by Nintendo of America Inc. (“Sponsor”)
in the format designated below. Directors, officers and employees
of Sponsor and its affiliate companies, subsidiaries, agents,
professional advisors, advertising and promotional agencies,
and immediate families (parents, children, siblings or spouse)
and those residing in the same household, whether related or
not, of each of these individuals, are not eligible to enter.
All applicable federal, state and local laws and regulations
apply. Offer void where prohibited.
2. Disclaimer. Sponsor and its parent company, subsidiaries,
and affiliates, and their respective directors, officers, professional
advisors, employees and agencies will not be responsible for:
(a) any late, lost, misrouted, or damaged entries; (b) any Contest
disruptions, injuries, losses, or damages caused by events beyond
the control of Sponsor; or (c) any printing or typographical
errors in any materials associated with the Contest.
3. Contest Period. The F-Zero GX Championship Contest consists
of two periods: a) the Sapphire Cup which will run from 12:00
AM Pacific Time on October 22, 2003 to 11:59 PM Pacific Time
on November 12, 2003, and b) the Emerald Cup which will run
from 12:00 AM Pacific Time on November 19, 2003 to 11:59 PM
Pacific Time on December 10, 2003. Your entry must be received
by each Cup's deadline to be eligible to win a prize for that
Cup.
4. Prizes. In each individual Cup there will be will be five
(5) courses and three (3) winners per course, resulting in a
total of fifteen (15) winners per Cup, with a total of thirty
(30) winners overall. Winners will be determined by the fastest
times entered on the Cup's Leaderboard by eligible entrants.
Each entrant whose time is among the top three (3) eligible
times for a given course will win a prize. Each of the thirty
(30) prize winners will receive an F-Zero: GX Championship Plaque
and an F-Zero: GX mousepad (ARV: $30.00 each). Odds of winning
depend on the total number of eligible entries. Many will enter,
a total of thirty (30) will win a prize.
ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT
OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
If you are selected as a winner and you are under the legal
age of majority in your state of residence (a “Minor”),
one of your parents or guardians must submit a signed, written
statement that they have read, understood and agree to the Contest
rules on behalf of you and themselves. Any prize won by a Minor
will be awarded to the Minor's parent or legal guardian on the
Minor's behalf.
Winners will be contacted by e-mail, using the e-mail address
they enter when entering their time on the Cup's Leaderboard
at http://ranking.f-zero.jp/gxe.html. If an e-mail address is
invalid or the winner does not respond within 14 days of being
notified of winning, the prize will be forfeited and will not
be awarded to an alternate winner. Prizes are not transferable.
No substitutions or exchanges (including for cash) of any prizes
will be permitted, except that Sponsor reserves the right to
substitute a prize of equal or greater value for any prize.
All prizes are awarded “AS IS” and WITHOUT WARRANTY
OF ANY KIND, express or implied, (including, without limitation,
any implied warranty of merchantability or fitness for a particular
purpose).
5. How to Enter. Contestants must have a copy of the F-Zero
GX video game for the Nintendo GameCube video game system and
play the game in order to enter this Contest. Contestants will
enter their scores on the leaderboard by going to http://ranking.f-zero.jp/gxe.html
and typing in the password generated at the end of game play
and completing the rest of the entry form. All information must
be filled in, including a valid e-mail address. Visit http://www.f-zero.com/championship/howtoenter.jsp
for instructions on how to generate a password upon completion
of a course. Only online entries will be accepted.
No mechanically or electronically reproduced entries will be
accepted. Anyone suspected of cheating or foul play will be
immediately disqualified and their entries will be deleted by
Nintendo's F-Zero GX Global Championship Certification Board
without notice. All decisions made by Sponsor are final. In
the event of a dispute as to any online entry, the account holder
of the email address used to enter will be deemed to be the
contestant (“account holder” being the natural person
to whom the email address is assigned by the relevant internet
access provider). Potential winners may be required to show
proof of being the account holder. High score winners may be
asked to submit their Nintendo GameCube memory card with a replay
of their fastest time to verify a score. Such memory cards will
be returned after verification.
6. Prize Notification. Each Cup's winners will be notified within
one week of the completion of the Cup. To claim a prize, winners
should follow the instructions contained in their notification.
7. General Release. By entering the Contest, you (and, if you
are a Minor, your parents or legal guardians) release Sponsor,
its parent company, subsidiaries, and affiliates, and their
respective directors, officers, employees and agencies (collectively,
the “Released Parties”) from any liability whatsoever,
and waive any and all causes of action, related to any claims,
costs, injuries, losses, or damage of any kind arising out of
or in connection with the Contest or delivery or misdelivery,
acceptance, possession, use of or inability to use any prize
(including, without limitation, claims, costs, injuries, losses
and damages related to personal injuries, death, damage to or
destruction of property, rights of publicity or privacy, defamation
or portrayal in a false light, whether intentional or unintentional),
whether under a theory of contract, tort (including negligence),
warranty or other theory.
8. Use of Winner’s Name, Likeness, etc. Except where prohibited
by law, entry into the Contest constitutes permission to use
winner’s name, address, likeness and/or prize information,
without limitation, for promotional purposes without further
permission or compensation. As a condition of being awarded
any prize, except where prohibited by law, winners may be required
to execute a consent to the use of their name, address, likeness
and/or prize information, without limitation, for promotional
purposes without further permission or compensation.
9. Affidavit & Release. As a condition of being awarded
any prize, winners will be required to execute and deliver to
Sponsor a signed affidavit of eligibility and acceptance of
these Official Rules and release of liability.
10. Winners List; Rules Request. For a copy of the winners list,
send a stamped, self-addressed, business-size envelope after
December 17, 2003 and before December 17, 2004 to Sponsor at
the address listed below, Attn: F-Zero GX U.S. Championships
Contest Winners List. To obtain a copy of these rules, send
a stamped, self-addressed business-size envelope to Sponsor
at the address listed in Paragraph 12 below, Attn: F-Zero GX
U.S. Championships Contest Rules Request. Residents of VT may
omit return postage.
11. Miscellaneous. The Contest and these Official Rules will
be governed, construed and interpreted under the laws of the
State of Washington. Contestants agree to be bound by these
Official Rules and by the decisions of Sponsor, which are final
and binding in all respects. Sponsor reserves the right to change
these Official Rules at any time, in its sole discretion, and
to suspend or cancel the Contest or any contestant’s participation
in the Contest should unauthorized human intervention or other
causes beyond Sponsor’s control affect the administration,
security or proper play of the Contest or Sponsor otherwise
becomes (as determined in its sole discretion) incapable of
running the Contest as planned. Contestants who violate these
Official Rules, tamper with the operation of the Contest or
engage in any conduct that is detrimental or unfair to Sponsor,
the Contest or any other contestant (in each case as determined
in Sponsor’s sole discretion) are subject to disqualification
from entry into the Contest. If you have any questions about
